Scarlett Panda Terms and Conditions

ABOUT US

These Terms govern your use of Scarlett Panda websites, applications and services, including personalised stories, meditations, audio and related digital content (the Service).

Scarlett Panda is a trading name of Incremento Ltd, a company registered in England and Wales under company number 12997528. Our registered office is 128 City Road, London, United Kingdom, EC1V 2NX. Incremento Ltd is the contracting seller for Scarlett Panda services.

By creating an account, starting a trial, purchasing a subscription or using the Service, you agree to these Terms. If you are using the Service for a child, you confirm that you are the child’s parent or legal guardian, or that you have the parent or legal guardian’s permission.

ELIGIBILITY AND ADULT SUPERVISION

You must be at least 18 years old, or the age of legal majority where you live, to purchase a subscription or create an account for a child. The Service is designed for use by families under adult supervision. It is not a substitute for parental supervision, professional education, medical advice or emergency services.

THE SERVICE

Scarlett Panda allows an adult user to provide prompts and profile details to create personalised content. Features and availability may change as we improve the Service. Some content may be generated or assisted by artificial intelligence and can occasionally contain mistakes or unexpected material. An adult should review content before sharing it with a child and stop using any content that appears unsuitable.

ACCOUNTS

You are responsible for keeping account credentials secure and for activity carried out through your account. Information you provide must be accurate and kept up to date. Tell us promptly at info@scarlettpanda.com if you believe your account has been accessed without permission.

SUBSCRIPTIONS, TRIALS AND RENEWAL

Scarlett Panda Premium costs USD $9.90 per month or USD $79 per year.

The monthly plan does not include a free trial. The annual plan includes a seven-day free trial. Unless you cancel before the trial ends, the annual plan automatically converts to a paid USD $79 annual subscription.

Subscriptions renew automatically for the same billing period until cancelled. The price and renewal date are shown at checkout and in your receipt. If we change a subscription price, we will provide notice as required by applicable law before the new price applies to a future renewal.

PAYMENTS AND PADDLE

Where a purchase is processed by Paddle, Paddle acts as merchant of record for the payment transaction. Paddle’s Buyer Terms and checkout disclosures also apply to that transaction. Payment methods, taxes and currency conversion are handled as shown at checkout.

Do not send full payment-card details to Scarlett Panda by email.

CANCELLATION

You may cancel at any time through the Manage Subscription link in your Paddle receipt, the Scarlett Panda billing area, or Paddle Buyer Support at https://paddle.net.

Cancellation prevents future renewal. Unless applicable law or Paddle’s terms require otherwise, you keep access until the end of the current paid billing period.

REFUNDS

Refund requests are handled under our Refund and Cancellation Policy at /refund-and-cancellation-policy, Paddle’s Buyer Terms, Paddle’s Refund Policy at https://www.paddle.com/legal/refund-policy and applicable consumer law.

Nothing in these Terms limits any mandatory cancellation, refund or other consumer right that applies where you live.

YOUR INPUTS AND RESPONSIBILITIES

You are responsible for prompts, names, images, audio and other material you choose to submit. You must have the rights and permissions needed to provide that material, including any necessary permission from a child’s parent or legal guardian.

Do not submit unlawful, abusive, infringing, deceptive or unsafe material, or highly sensitive information that is not needed to use the Service.

You retain any rights you have in your inputs. You give Incremento Ltd a limited, non-exclusive licence to host, copy, process, adapt and transmit your inputs only as needed to operate, secure, support and improve the Service, comply with law and generate the content you request, subject to our Privacy Policy.

GENERATED CONTENT

Subject to these Terms and applicable law, you may use the personalised stories and other output generated for you for personal, non-commercial family use. Output may not be unique and other users may receive similar content.

You must review output before relying on or sharing it. We do not promise that generated content will always be accurate, complete, age-appropriate or free from third-party material.

OUR INTELLECTUAL PROPERTY

The Service, software, site design, trademarks and content supplied by us are owned by or licensed to Incremento Ltd and are protected by intellectual-property laws. Except for the limited personal use allowed by these Terms, you may not copy, sell, reverse engineer, scrape, redistribute or create a competing service from them without our written permission.

ACCEPTABLE USE

You must not misuse the Service, interfere with security or availability, attempt unauthorised access, upload malware, impersonate another person, use automated means to extract content at scale, infringe another person’s rights, or use the Service for unlawful, exploitative or harmful activity.

We may restrict or suspend access where reasonably necessary to protect users, children, the Service or third parties, investigate suspected misuse, comply with law or address non-payment. Where appropriate, we will give notice and an opportunity to resolve the issue.

AVAILABILITY AND CHANGES

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, security work, provider outages and events outside our reasonable control may affect availability.

We may update these Terms when the Service, law or our business changes. Material changes will be notified as required by law. The updated date appears at the top of this page.

LIABILITY

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, business loss arising from consumer use, or loss caused by your failure to follow reasonable instructions or secure your account.

ENDING YOUR ACCOUNT

You may stop using the Service at any time. Cancelling a subscription and deleting an account are separate actions. If you want account deletion, email info@scarlettpanda.com or use any deletion control provided in the Service. Some records may be retained where required for legal, fraud-prevention, tax, accounting or dispute purposes, as explained in our Privacy Policy.

GOVERNING LAW

These Terms are governed by the laws of England and Wales. If you are a consumer, you retain the benefit of mandatory laws and courts available to you in the country where you live.
